Do I need a Lawyer?

Not all cases require a lawyer

     It may seem odd for a personal injury lawyer to say that some injured people won't need a personal injury lawyer.  After all, you "don't ask a barber if you need a haircut"!.  Many small cases can be settled without an attorney and I'll tell you below how to get a copy of my Free Booklet explaining how you might be to settle your own claim.  


     You are bombarded with lawyer advertising by way of television, radio and billboards, confusing claims and sometimes simply bad information.  The truth is that many minor car wreck cases can be settled without a lawyer.   A capable lawyer can absolutely add value to the settlement and increase your recovery in even a small car wreck case, but often not enough to offset the fees of 33% to 40% of the mount recovered.   


     The type of case that can most likely be settled without an attorney is one in which you had only property damage ( a true fender bender), or one where you have only a short lived strain or sprain, didn't need medical care (or only saw a doctor once or twice) and have been discharged without any follow up care needed, and didn't lose more than a 4 or 5 days from work

     If your case involves broken bones, surgery, scarring, hospital admission, permanent injury or disability, then you will definitely want to hire a Personal Injury attorney.   In Georgia, you usually have 2 years from the date of the accident to file a lawsuit (the statute of limitations).  So, if you do decide to hire an attorney, do not wait until the last minute (for my firm, the "last minute" is is any time less than 3 months prior to the statute of limitations running out).  A good attorney will want to do an in-depth investigation before deciding whether your case is one that they want to accept. Waiting until the end of your statute of limitations period may mean that no attor­ney will want to take your case. 


If you decide to hire a lawyer

1. You have total expected medical bills and lost wages (not just out-of-pocket expenses) of at least $5,000.00 (including any amounts paid by insurance) 


2. There visible damage to your car


3. The wreck was someone else’s fault


4. You sought prompt medical treatment after the accident and followed the medical advice and course of treatment that was recommended


5.  The accident happened less than 20 months ago

  We know that choosing a lawyer to represent you in your injury claim can be a difficult and even life changing decision.


Although, from a legal perspective, in most cases you have two years from the date of your injury to file a lawsuit, there there are many steps to be taken during those two years that may result in the conclusion of your case before filing suit. Some cases can go on for years due to legal complexities. Some cases settle in months, usually because the client’s injuries and damages far exceed the insurance coverage available, so the insurance company pays the policy limits fairly quickly. But, on average, the process of concluding your case can take a year or more for clients who are badly injured.  


Many television and radio advertisements give the impression that a settlement check magically appears upon making a quick phone call after an accident or injury.
